1. Introduction Welcome to Onboardly! These Terms and Conditions (“T&Cs”) govern your use of Onboardly, a digital employee onboarding platform that integrates seamlessly with PaySpace to streamline and automate the onboarding process. By using our platform, you agree to be bound by these T&Cs. If you do not agree, please refrain from using Onboardly.
2. Definitions
“Onboardly” refers to the digital employee onboarding solution developed and provided by Adaptablist (Pty) Ltd.
“User” refers to any individual or entity using Onboardly, including HR personnel, employers, and new hires.
“Employer” refers to the organization utilizing Onboardly for employee onboarding.
“Employee” refers to an individual undergoing onboarding via Onboardly, who is being employed by the employer.
“Personal Information” means any identifiable data submitted by users during the onboarding process.
3. User Obligations
By accessing or using Onboardly, users agree to be bound by these Terms and Conditions. Users must review these terms before proceeding with the use of the platform.
Users must provide accurate, complete, and up-to-date information during the onboarding process. Onboardly can only process what has been entered or captured by the user.
Users are responsible for maintaining the confidentiality of their login credentials and for all activities under their account.
Users must comply with all applicable laws and regulations while using Onboardly.
Employers must ensure that their use of Onboardly aligns with employment laws and data protection regulations. Onboardly is not responsible for any employment commitments, offers, letters, conditions, or agreements under which the employee will be employed. It serves solely as a facilitation tool for the onboarding process.
4. Company Obligations
Adaptablist (Pty) Ltd reserves the right to modify, suspend, or discontinue any aspect of Onboardly at any time without prior notice. Users acknowledge that continued use after modifications constitutes acceptance of the changes.
Onboardly ensures secure integration with PaySpace to facilitate seamless profile creation.
We implement industry-standard security measures to protect personal information, including secure data transmission, encryption, and infrastructure redundancy to maintain service availability.
Onboardly operates on reliable cloud infrastructure with redundant data centers to maximize uptime and minimize service interruptions.
We provide technical support to ensure continued functionality and user experience.
5. Intellectual Property
Onboardly is a product operated by Adaptablist (Pty) Ltd. All associated content, software, and branding are the intellectual property of Adaptablist (Pty) Ltd.
Users are granted a limited, non-exclusive, non-transferable license to use Onboardly solely for onboarding purposes.
Users may not modify, distribute, or reproduce any part of Onboardly without prior written consent.
6. Data Processing and Privacy
Onboardly collects and processes personal information in accordance with its Privacy Policy.
Users consent to the collection, storage, and processing of personal data required for onboarding and PaySpace integration.
Onboardly does not store personal information long-term. Successfully integrated records are deleted after 7 days, while records not yet transferred to PaySpace will be retained for 30 days unless customer-specific requirements mandate longer retention.
After termination of an agreement, all remaining data will be retained for 30 days, and it is the customer’s responsibility to retrieve or extract their data within this period.
Onboardly does not sell, share, or distribute personal information to unauthorized third parties.
Employers are responsible for ensuring compliance with relevant data protection laws when using Onboardly.
7. Limitation of Liability
Users acknowledge that Onboardly integrates with third-party services, such as PaySpace, and Onboardly is not responsible for any issues, inaccuracies, or service interruptions originating from these third-party platforms.
Onboardly is provided “as is” and “as available” without warranties of any kind.
We do not guarantee uninterrupted or error-free service, although we strive for optimal performance through reliable infrastructure and monitoring.
Onboardly is not responsible for errors or discrepancies resulting from user-provided information or third-party integrations (e.g., PaySpace).
To the fullest extent permitted by law, Onboardly shall not be liable for any indirect, incidental, or consequential damages arising from the use of our platform.
8. Termination
Users may terminate their Onboardly account at any time by providing written notice.
Onboardly reserves the right to suspend or terminate user access for violations of these T&Cs or misuse of the platform.
Upon termination, all personal data will be handled according to our Privacy Policy and applicable laws, with final data retention lasting 30 days before permanent deletion.
9. Amendments to the T&Cs
Onboardly reserves the right to modify these T&Cs at any time.
Users will be notified of significant changes via email or platform notifications.
Continued use of Onboardly after amendments constitutes acceptance of the updated T&Cs.
10. Governing Law
These T&Cs shall be governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in South Africa.
11. Indemnification
Users agree to indemnify and hold Adaptablist (Pty) Ltd harmless in relation to Onboardly from any claims, damages, or expenses arising from their use of the platform, violation of these T&Cs, or reliance on third-party services. These T&Cs shall be governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in South Africa.
